New Draft Local Planning Scheme No. 1

The City of Albany has undertaken an extensive public consultation process to encourage Albany residents to make submissions on the draft Local Planning Scheme 1 (LPS1). The consultation process ran for four months and closed 3 August 2012. A total of 198 submissions were received.

The City’s planning officers have recommended a number of changes to draft LPS1 as a result of responding to issues raised in submissions.  

All submissions and the City’s response thereto are contained in the ‘Schedule of Submissions’. The Schedule of Submissions is divided into 8 volumes as follows:

The following provides an explanation of the terminology used in the recommendation: 

‘Accept’ means that the City accepts the planning matters raised in the submission and recommends that draft LPS1 should be modified to correct/improve the content or maps of LPS1.

‘Accept in part’ means that the City accepts some of the planning matters raised in the submission and recommends that draft LPS1 be modified to the extent to which the submission is agreed to.  

‘Reject’ means that the City rejects the planning matters raised in the submission and no change to draft LPS1 is recommended.To avoid delays to the final approval of the Local Planning Scheme 1, the City’s planning staff did not support major modifications to the draft scheme; modifications where additional information or reports were required to support the modification, where extensive consultation or re-advertising will be required; or modifications that have the potential to prejudice the land uses or amenity of neighbouring property owners.  

Where a submission is considered to have potential merit, but is likely to result in re-advertising, or should be supported by additional technical information, the submission is recommended to be rejected and a recommendation made under ‘Other City Recommendations’ that the matter be investigated as part of the review of the Albany Local Planning Strategy and/or that it could be considered through a separate amendment to LPS1 after gazettal. This particularly relates to submissions that request rezoning of land where detailed investigation (such as land capability, fauna and flora assessment, fire risk etc.) may be required. Submissions for spot rezoning were also recommended for rejection as this has potential to affect amenity, or the orderly planning of an area, and has potential to create land use conflict in some areas.

Special Council Meeting 

A Special Council Meeting will be held to adopt the draft LPS1 as follows:

Public speaking time is in accordance with Council Meeting public question time protocol.

Finalisation of draft LPS1 

Town Planning Regulations 1967 stipulate the process relevant to the finalisation of draft LPS1. Following adoption of draft LPS1 for finalisation, the City refers all of the submissions and associated scheme documents to the WA Planning Commission for their consideration and assessment. The WA Planning Commission then makes a recommendation to the Minister for Planning. The Minister for Planning will make the final determination on the Scheme. When the Scheme is approved, the City will publish a notice of approval in the local newspaper and advise all submitters of this outcome.

A vision for development

The City of Albany is responsible for providing a vision for the future development of Albany, as well as for assessing the planning merit of individual projects on private lots.

The Albany Local Planning Strategy draws together all of the strategies prepared in the past and provides the blueprint for the City’s growth over the next two decades.

City Planners are available to assist residents, investors and landowners with any planning inquiry and they encourage proponents to discuss their projects with staff at a preliminary stage, well before formal lodgement, to expedite the approval process.

The City’s Town Planning Schemes provide the legal framework against which individual development proposals will be considered.

Municipal Heritage Inventory

The City of Albany Municipal Heritage Inventory provides the Planning Department with information relating to places of heritage value and is a record of the history of the City and the places that reflect the story of the district.

A set of management categories are in place, with different management recommendations for each.  These categories will not all have the same implications for owners, as places in the highest category will need more careful management and assessment than will those places in the lower categories.

Planning scheme consent is required for most developments affecting a property/building/place recorded on the Municipal Heritage Inventory, depending on the management category recorded.
